TERMS AND CONDITIONS FOR HYBRID BATTERY RECONDITIONING SERVICES

Guarantee

In the event of hybrid battery failure during the guaranteed period necessitating repairs, customers are entitled, subject to the terms and conditions outlined below, to free repair/reconditioning of the battery, inclusive of parts and labor, following diagnostic assessment and investigation to confirm the fault and vehicle condition. The original repair’s agreed-upon guarantee period remains applicable.

Exempt from Claims

No reimbursement claims can be made for:

• Vehicle breakdown recovery, accommodation expenses, parking fees, fines, loss of use, postage, delivery expenses, or any other direct or indirect consequences.
• Claims cannot be made for damages resulting from weather events (storms, lightning, earthquakes, floods), explosions, or fire.
• Vehicle accidents, collisions, external impacts, or force applied to the vehicle.
• Third-party outsourced work during the guarantee period.
• Intentional or negligent actions, use of improper fuels/lubricants, towing beyond manufacturer guidelines, water ingress, corrosion, or contaminated fluids.

Conditions of the Guarantee

The guarantee is contingent upon the following conditions, without prejudice:

1. The guarantee solely covers the reconditioned HV battery; no other hybrid system component is included.
2. The HV battery fan and pneumatic cooling system must be in a serviceable condition, with no evidence of foreign object contamination or faults affecting the HV battery.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, but not limited to, a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms that, by their nature, should survive termination shall survive termination. These provisions include but are not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law These Terms shall be governed and construed in accordance with the laws of Illinois, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements between us concerning the Service.

Changes We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days’ notice prior to the new terms taking effect. What constitutes a material change will be determined solely by us.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
